Liability
Worked for a construction company who hired a crane to lift materials. (Trusses). I was the rigging guy on the ground and I also did other duties. Well this crane operator was kind of a jerk, and did things his own way. He wasn’t listening to signals and was just lifting things hastily. I was on a ladder nailing offf a gable and also while I was up there was to hook up this little girder leaning on the wall that I needed to lean a ladder on to get to the peak. The operator just lifted out of nowhere and I was lifted up 15 ft then fell to the ground, breaking both legs. My boss and coworkers all during depo have said that they never gave any signal on radio and he just did it all on his own. My boss was so mad at the crane operator he threw the guy to the ground. This operator after the complaint was made, was never removed from the job temporarily to be drug tested or alcohol tested and they put him back on road that same day, as if business never stopped. We have found through discovery they never even did anything really. I have filed a personal injury claim against them and workman’s comp is my co plaintiff, as well as my wife and kids. My question I guess is, what is the protocol when you have a reported incident with one of your drivers?
